Pieter Swart entered into a settlement agreement, in a constructive dismissal dispute in the CCMA, on behalf of RPL Assessment Centre in the sum of R14 400. After failing to comply with the terms of the settlement agreement, it made an order of the court – interestingly by the same person who awarded the Interpleader aginst RPL Assessment Centre.
Despite a number of telephonic and text messages of assurance of settlement, Pieter Swart (in defiance of the order of the court) failed again to meet his obligations.
The sheriff return again suggests that the Sheriff of the court was deliberately mislead in the execution of the order.
